Terms of service

Below you will find our terms and conditions that apply to all sales of products and services from Vestland Chili to consumers in Norway. Consumer purchases are regulated, among other laws, by the Consumer Purchase Act, the Right of Withdrawal Act, the Marketing Act, the Personal Data Act, the E-commerce Act, and the Credit Purchase Act. If you have questions about your rights and the legal framework surrounding purchases, we recommend visiting the Consumer Portal. If you are under 18 years old, you must have a legal guardian, such as a parent, make purchases on your behalf.

Order Process

Your order is binding once registered in our system, and if you wish to cancel, you must contact us immediately after ordering. Upon receiving your order, we will confirm and send an automatic confirmation to you. It's important to review this confirmation to ensure it matches your order. If there is an issue with your order, please contact us via email immediately.

Information on the Website

We strive to provide our customers with accurate product information. However, we reserve the right for potential typographical or printing errors that may prevent us from fulfilling orders as described on our website or in our marketing. Furthermore, we reserve the right to cancel your order or parts of it if the desired item is out of stock. In such situations, we will contact the buyer to find an alternative solution.

Prices and Payment

All prices are in Norwegian kroner, including VAT and excluding shipping, unless explicitly stated otherwise. If paying by card, the amount will be charged immediately. Information on total costs, including shipping and other fees, will be provided before completing the order. We reserve the right to cancel a purchase or change the price due to significant typographical or printing errors, even if you have received an order confirmation. With our payment partner Klarna, you can pay by card, invoice, or installment. You can also pay via Vipps or Stripes, where the purchase amount is deducted immediately.

Delivery

We deliver throughout Norway, excluding Svalbard and Jan Mayen. Once we approve your order, we will send an order confirmation via email. We ship items once a week, and the expected delivery time with Posten's service package is 2-4 working days depending on your location in the country. Our shipping costs are based on the total amount, with a cost of 60 NOK for regular packages and free shipping for orders over 450 NOK. Packages are delivered to the nearest post office or mailbox if the volume allows. If the delivery time is not specified in the ordering solution, the seller must deliver the goods to the buyer without undue delay and no later than 30 days after the order from the customer. Packages can be held at Posten for 14 days.

Examination of Products

Upon receiving the products, please promptly check if the delivery matches the order confirmation, if the products were damaged during transport, or if there are any other defects or deficiencies.

Delay and Non-Delivery

If the seller fails to deliver the goods or delivers late according to the agreement between the parties, and this is not due to the buyer or circumstances on the buyer's side, the buyer may withhold the purchase amount, demand performance, terminate the agreement, and/or seek compensation from the seller. However, the buyer cannot demand performance if there is an obstacle that the seller cannot overcome, or if performance would result in significant inconvenience or cost to the seller. Claims for breach of contract should be made in writing for evidential purposes.

Complaints

If a product has a defect, you must notify us within a reasonable time after discovering the defect. However, the deadline for complaints is no less than two months from when the defect was discovered. If you do not complain in time, you forfeit the right to claim the defect. When making a complaint, provide all information needed for the seller to assess the complaint, such as the product in question, the purchase date, and a description of the defect. Complaints should be made in writing via email to the seller.

Changes to Terms

Vestland Chili reserves the right to change these terms, including due to changes in legislation.

Force Majeure

If the seller is prevented from delivering or performing mandatory re-delivery – or if such a delivery obligation becomes unreasonably burdensome due to labor disputes or any other circumstance beyond the parties' control, such as fire, war, mobilization, or unforeseen military conscription of a similar extent, requisition, confiscation, currency restrictions, riots and riots, scarcity of transportation, general scarcity of goods, restrictions on the supply of fuel, and deficiencies or delays in deliveries from subcontractors or manufacturers due to such circumstances as discussed in this section, the seller is exempt from all liability other than in cases of complaint and will credit the defective item's purchase amount.

Personal Information

When you shop with us, we store information such as name, address, phone number, and email address. This information is necessary to deliver the goods to you and to contact you regarding your order. Vestland Chili focuses on handling personal information in an encrypted and secure manner, and we do not sell, exchange, or disclose personal information to third parties. Card numbers and all card transactions occur externally with authorized payment service providers.

Reservation

We reserve the right to errors in prices, text/specifications, and that certain products and sizes may be sold out.

Conflict Resolution

Complaints should be directed to the seller within a reasonable time, and the parties should attempt to resolve any disputes amicably.
